Terms of Service

1. Acceptance of Terms

By accessing and using Post8 (the "App"), you accept and agree to be bound by the terms and provisions of this agreement. These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of the terms, then you may not access the App.

2. Description of Service

Post8 is a mobile application that uses artificial intelligence to analyze images and generate captions, song suggestions, and "vibe checks" for social media posts.

AI Disclaimer

The App uses Google Gemini and other AI technologies to generate content. You acknowledge that AI outputs are probabilistic and may be inaccurate, offensive, or inappropriate. Post8 does not guarantee the accuracy, truthfulness, regulatory compliance, or suitability of any generated content.

3. User Accounts

You may need to create an account to access certain features. You are responsible for safeguarding your account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.

4. Subscriptions and Payments

Post8 may offer "Pro" or "Premium" subscriptions that unlock additional features or usage limits.

Billing: Subscriptions are managed and billed by the applicable app store (Apple App Store or Google Play Store). Payment will be charged to your iTunes or Google Play Account at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellations: You can manage and cancel your subscription in your device's account settings. We cannot directly cancel or refund subscriptions processed by app stores. Additional terms from Apple or Google may apply.
Rate Changes: We reserve the right to modify subscription fees at any time. Any subscription fee change will become effective at the end of the then-current Billing Cycle.

5. User Content and Permissions

By uploading images to the App, you grant Post8 a temporary, non-exclusive, worldwide, royalty-free license to process, analyze, and transmit your content to third-party AI providers (such as Google) solely for the purpose of providing the service.

Ephemeral Processing: We do not claim ownership of your images. We do not permanently store your images on our servers. Images are processed ephemerally and discarded immediately after analysis is complete.

You represent and warrant that you own or have the necessary rights to use the images you upload and that your use of the images does not violate any third-party rights.

6. Prohibited Use

You agree not to use the App to:

Upload illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or sexually explicit content.
Violate any applicable laws or regulations, including but not limited to intellectual property and privacy laws.
Reverse engineer, decompile, or attempt to extract the source code of the App.
Use the App to develop a competing service.
Interfere with or disrupt the integrity or performance of the App.
Attempt to gain unauthorized access to the App or its related systems or networks.

7. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Post8 and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Indemnification

You agree to defend, indemnify, and hold harmless Post8 and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POST8 AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through the App. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
